Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") form a binding agreement between you and Babelo ("VistaSpots", "we", "us", or "our") regarding your access to and use of the VistaSpots mobile application and related services.

By downloading, accessing, or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be legally capable of entering into a binding contract to use VistaSpots. If you are under the age of majority where you live, you may use the service only with permission from a parent or legal guardian.

3. Accounts, Sign-In, and Deletion

You may use most parts of the service as a guest. Some features (such as syncing collections across devices, sharing cards, or restoring purchases) require an account. We currently support sign-in with Apple, Google, and email magic link.

You are responsible for maintaining the security of your account and for activities that occur under it.

In compliance with Apple's requirement that apps which support account creation also support in-app account deletion, you can delete your account at any time from Profile → Account → Delete Account inside the app. The flow requires typing "DELETE" to confirm and is irreversible.

4. Limited License

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use VistaSpots for your personal, non-commercial use.

5. What the Service Does — and Does Not Do

VistaSpots helps users discover scenic spots, verify proximity using location-based logic and related signals, capture or upload photos, and unlock collectible postcard-style cards.

The card you collect after a successful check-in is a pre-designed illustration for that spot. Your captured photo is used to verify the check-in; it is not the card itself.

The service is for personal travel memory, collection, and entertainment purposes. It is not a government record, not a certification of legal presence, not a permit, not a ticketing product, and not a guarantee that you physically stood at a specific centimeter-level viewpoint.

VistaSpots is an evolving service. Spot availability, collections, GPS coordinates, viewing angles, descriptions, verification rules, card artwork, and related content may be updated, corrected, suspended, or removed over time.

Geofence checks, GPS coordinates, viewing angles, overlays, spot descriptions, and related prompts are approximate and may be affected by weather, terrain, maps, GPS drift, device limitations, congestion, access restrictions, user feedback, or other factors.

6. Spot and Collection Availability

We may add, update, suspend, remove, or replace spots, collections, location data, verification logic, artwork, metadata, and related service content for safety, access, accuracy, legal, licensing, operational, product, user feedback, or other reasons.

If a spot or collection is removed, users who have not collected it may no longer be able to access or collect it. For users who previously collected it, we may continue showing a record of the collection where reasonably practical, but we may update or remove official artwork, metadata, verification details, or related service content.

We are not required to provide advance notice for every content, spot, collection, artwork, location, or verification change. If a change materially affects the service or notice is required by law, we may provide notice through the app, email, or other reasonable means.

7. Safety and Real-World Conduct

You are solely responsible for your conduct in the real world while using VistaSpots. You must obey park rules, posted signage, private property boundaries, traffic laws, weather warnings, ranger instructions, permits, fees, and all applicable laws.

Do not trespass, enter restricted areas, block traffic, ignore hazards, take unsafe photos, use the app while driving, or rely on the service in emergencies.

The app may suggest viewpoints near roads, cliffs, water, wilderness areas, or crowded public spaces. You assume the risks of travel and outdoor activity.

8. User Content

You retain ownership of photos and other content you submit, subject to the rights you grant us in these Terms.

By uploading, capturing, storing, or sharing content through the service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, transform, and display that content solely as needed to operate, secure, improve, and provide the service to you, including verifying check-ins and generating thumbnails or backups. We do not take a broader marketing license to your photos. If we ever want to feature user content publicly, we will ask through a separate opt-in.

Removing or changing an official spot, collection, card design, or illustration does not transfer ownership of your submitted photos or other user content to us.

9. Your Responsibilities for Content

You represent that you have the rights necessary to submit the content you use with the service and that your content does not infringe intellectual property, privacy, publicity, or other rights of any person.

If your photo includes another identifiable person, sensitive location, or protected artwork, you are responsible for any permissions required for your chosen use or sharing.

10. Prohibited Conduct

You may not:

  • Use the service for unlawful, harmful, deceptive, or fraudulent purposes.
  • Attempt to bypass geofence, verification, or anti-abuse systems, including through spoofed location, bots, scripts, or manipulated media.
  • Reverse engineer, copy, scrape, resell, or exploit the service except as allowed by law.
  • Interfere with the service, security features, or other users.
  • Upload malware, abusive material, or content that violates law or the rights of others.

11. Intellectual Property

The service, including the app, software, design, text, graphics, overlays, card illustrations, card templates, and branding, is owned by Babelo or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership to you.

You may use generated cards for personal use and sharing as the product permits. Any broader commercial use, resale, automated extraction, or white-label use requires our written permission.

Official card illustrations, templates, designs, and related presentation elements may be updated, replaced, regenerated, or removed as part of the evolving service. We do not guarantee that a specific official card design or artwork version will remain available permanently.

12. Third-Party Services and Platforms

The service may interoperate with or link to Apple, Google, mapping providers, cloud providers, analytics providers, social platforms, and other third parties. Your use of those third-party services is governed by their own terms and policies.

13. Suspension and Termination

We may suspend, restrict, or terminate access to the service if we believe you violated these Terms, created risk, harmed other users, exposed us to liability, or used the service abusively or unlawfully.

You may stop using the service at any time. If you created an account, you may delete it at any time from Profile → Account → Delete Account, or by contacting us.

14. Disclaimers

The service is provided "as is" and "as available." To the maximum extent permitted by law, Babelo disclaims warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, completely accurate, secure, or available at all times, or that every check-in attempt will succeed.

15. Limitation of Liability

To the maximum extent permitted by law, Babelo and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or opportunities arising out of or related to the service.

To the maximum extent permitted by law, the total liability of Babelo for all claims arising out of or relating to the service will not exceed the greater of (a) the amount you paid us for the service in the 12 months before the claim arose, or (b) US$50.

16. Indemnity

You agree to indemnify and hold harmless Babelo and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, judgments, losses, and expenses arising out of your content, your misuse of the service, your violation of these Terms, or your violation of law or the rights of others.

17. Changes to the Service or Terms

We may modify the service, add or remove features, update availability, change verification rules, revise official content, or update these Terms from time to time. If changes are material, we will provide notice as required by law. Your continued use after the updated Terms take effect means you accept the updated Terms.

18. Governing Law and Dispute Resolution

The governing law and dispute resolution venue for these Terms will be determined based on Babelo's final business location and applicable law.
